Atlas does not guarantee: - revenue increases; - cost savings; - regulatory outcomes; - clinical outcomes; - legal outcomes; - financial outcomes; - productivity improvements; - technology performance beyond contractual commitments; or - a particular business result, unless expressly stated in a written agreement.

18. Historical and Team Experience

Statements concerning experience predating the Atlas brand may refer to the professional history of founders, employees, contractors, partners, or members of the team now operating under Atlas. Such statements should not be interpreted as representing that JUMO Corporation or the Atlas brand itself provided services before its legal or commercial existence.

19. Privacy

Our collection and processing of personal information through the website is described in the Atlas Privacy Policy, which forms part of the framework governing use of the site.

20. Security

21. Disclaimer of Warranties

To the maximum extent permitted by applicable law, this website and its publicly available content are provided on an “as is” and “as available” basis. Atlas disclaims warranties not expressly provided in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability to the extent such disclaimers are legally permitted. Nothing in these Terms limits warranties or rights that cannot lawfully be excluded.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Atlas, JUMO Corporation, and their directors, officers, personnel, affiliates, and authorized representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of the public website, including loss of profits, revenue, opportunity, goodwill, or data. Where liability cannot lawfully be excluded, it will be limited only to the extent legally permitted. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or another liability that applicable law does not permit a party to exclude or limit. Liability arising from contracted Atlas services is governed by the applicable customer agreement rather than this public website clause.

23. Indemnification for Misuse

To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, claims, or reasonable expenses arising from your unlawful misuse of this website, your violation of these Terms, or your infringement of third-party rights. Atlas may restrict or terminate access to the website where reasonably necessary because of: - suspected unlawful conduct; - security concerns; - violation of these Terms; - attempts to disrupt the website; or - legal or regulatory requirements.

26. Governing Law

Except where mandatory law provides otherwise, these Terms and disputes relating specifically to use of the Atlas public website are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any client services agreement may contain different governing-law and dispute-resolution provisions.

27. Jurisdiction

Subject to mandatory rights under applicable law, disputes relating solely to use of this public website that cannot be resolved informally shall be submitted to the appropriate courts having jurisdiction over the location of JUMO Corporation's principal office in the Philippines. Before publishing, replace this sentence with the specific venue after confirming the principal-office address appearing in JUMO Corporation's corporate records. For example, if the registered principal office is in Bacolod City, counsel may elect wording referring specifically to the appropriate courts of Bacolod City, Negros Occidental.

28. Mandatory Local Rights

Nothing in these Terms is intended to waive or restrict any right or remedy that cannot legally be waived under the law applicable to the user. If a provision of these Terms conflicts with a mandatory local law applicable to you, that mandatory law will control to the required extent.

29. Changes to These Terms

Atlas may update these Terms periodically. Updated Terms will display a revised “Last Updated” date. Changes apply prospectively unless applicable law requires otherwise. Continued use of the website after updated Terms become effective constitutes acceptance to the extent permitted by law.

30. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the maximum extent permitted by law. The invalid provision will be interpreted or modified, where legally permissible, to most closely achieve its intended lawful purpose.

31. No Waiver

A failure by Atlas to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

32. Entire Website Agreement

These Terms and the Privacy Policy constitute the general agreement governing use of the Atlas public website. They do not replace separate contracts governing Atlas client services, software products, employment, contractor relationships, or other arrangements.
